Terms of Service for KEBCO.tech Smart Labels

By using KEBCO.tech Smart Labels (“the Platform,” “we,” “us,” or “our”), you agree to the following Terms of Service (TOS). These terms govern your access to and use of our services, and by using our services, you accept and agree to these terms. Please read them carefully.

1. Acceptance of Terms

By accessing or using KEBCO.tech Smart Labels, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service and any additional terms or policies that may apply to specific services or features provided by the Platform.

2. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

2.1 Falsifying, Tampering, or Manipulating the Traceability System

You shall not engage in any action that interferes with or undermines the integrity of the Platform’s traceability system, including but not limited to:

  • Tampering with Logs or Data: You may not manipulate, modify, or delete updates, posts, or any data associated with a tag. All interactions within the Smart Labels system are part of an immutable traceable history, and any attempt to alter this history is strictly prohibited.

  • Fabricating Data: You may not submit false or misleading updates or information to tags in an attempt to deceive other users, gain an unfair advantage, or disrupt the Platform’s functionality.

  • Bypassing Version Control: You are prohibited from bypassing any version control or data retention mechanisms that ensure the transparency and traceability of Smart Labels data. This includes efforts to hide previous versions or suppress the visibility of historical updates.

  • Manipulating Access or Activity Logs: You shall not attempt to tamper with, erase, or alter any logs or records related to your usage of the Platform, including interaction history, login records, or tag updates.

2.2 Spam and Malicious Content

You are prohibited from using KEBCO.tech Smart Labels to distribute unsolicited content or engage in malicious activities such as:

  • Posting Spam: Posting irrelevant, repetitive, or unsolicited content including advertisements, promotions, or phishing attempts.

  • Distributing Malware or Phishing Links: Sharing malicious links, files, or content that could harm other users or compromise the security of their devices.

2.3 Unauthorized Access

You shall not attempt to gain unauthorized access to the Platform, its systems, or other users’ accounts, including:

  • Account Hacking: Using any method to obtain access to another user’s account, including password guessing, phishing, or other malicious activities.

  • System Hacking: Attempting to manipulate or interfere with the Platform’s backend, databases, or infrastructure in any way.

2.4 Intellectual Property Violations

You shall not upload, post, or distribute content that infringes upon the intellectual property rights of others, including:

  • Copyrighted Material: Uploading or distributing materials without proper authorization or ownership rights.

3. Consequences of Violations

Any attempt to falsify, manipulate, or tamper with the traceability system or engage in prohibited activities will result in immediate suspension or termination of your account. In addition to being banned from using KEBCO.tech, you may face legal consequences as a result of fraudulent or criminal activities.

KEBCO.tech reserves the right to report any violations of these Terms of Service, including cybercrimes, to law enforcement agencies and to cooperate fully in any investigation or prosecution of such activities.

4. Platform Integrity and Security

KEBCO.tech employs a robust system to ensure the integrity and security of the Smart Labels Platform, including the traceability system. This includes:

  • Immutable Logs: All actions, updates, and interactions are timestamped and securely logged, creating a transparent and auditable history of all activities within the system.

  • Version Control: We maintain versioned records of all changes made to tags and associated data to ensure traceability and prevent data manipulation.

You agree to respect the integrity of this system and not attempt to bypass or interfere with these protections.

5. User Content and License

By posting content (such as updates, metadata, photos, or other materials) to the Platform, you:

  • Retain ownership of your content but grant KEBCO.tech a non-exclusive, royalty-free license to use, store, and display your content on the Platform, as necessary to provide the service.

  • Acknowledge that your content may be publicly accessible if you are using the free version of KEBCO.tech Smart Labels. If you wish to restrict access to your content, we recommend subscribing to the Pro version, which offers enhanced privacy controls.

6. Subscription Terms and Pricing (Pro Version)

KEBCO.tech offers both a free and Pro version of its Smart Labels services. By subscribing to the Pro version, you gain additional privacy controls, including the ability to restrict access to your tags and updates.

  • Subscription Payments: Subscriptions are billed on a monthly or annual basis, and payments are processed via our third-party payment providers.

  • No Refunds: Subscription payments are non-refundable.

  • Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless canceled prior to the renewal date.

7. Limitation of Liability

Public Use of Smart Labels Without Pro Version:

  • No Guarantee of Privacy: If you are using the free version of KEBCO.tech Smart Labels, you acknowledge that any data you post (including updates, tags, and metadata) is publicly accessible to anyone who has the link or QR code associated with your tag. KEBCO.tech is not liable for any misuse, unauthorized access, or loss of data resulting from your choice to use the free version.

  • Limited Liability for Public Content: KEBCO.tech is not liable for any damage, loss, or harm that may result from public exposure of your content or data, including but not limited to misuse, harassment, or identity theft.

  • Pro Version Provides Enhanced Privacy Controls: The Pro version of KEBCO.tech provides additional privacy features, allowing users to restrict access to their content. By using the free version, you accept that your data may be publicly accessible, and you release KEBCO.tech from any liability resulting from such access.

To the fullest extent permitted by law, KEBCO.tech shall not be held liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, revenue, or profits, arising from your use of the Smart Labels platform, especially when used publicly.

8. Indemnification

You agree to indemnify, defend, and hold harmless KEBCO.tech and its officers, employees, agents, and affiliates from any claims, damages, losses, and expenses (including legal fees) arising from your violation of these Terms of Service or unlawful use of the Platform.

9. Feedback and Suggestions

Any feedback or suggestions you provide regarding the Platform become the exclusive property of KEBCO.tech, and we are under no obligation to compensate you for such contributions.

10. Force Majeure

KEBCO.tech shall not be liable for any failure to perform its obligations under these Terms of Service if such failure is due to circumstances beyond its reasonable control, including natural disasters, government actions, or other events beyond KEBCO.tech’s control.

11. Termination of Service

KEBCO.tech reserves the right to suspend or terminate your account at any time if you violate any terms in this agreement. Upon termination, you must cease all use of the Platform, and any data associated with your account may be deleted from our systems, except where retention is required for legal reasons.

12. Governing Law and Dispute Resolution

These Terms of Service shall be governed by the laws of Republic of the Philippines. Any disputes arising from or related to these Terms shall be resolved through binding arbitration in City of Las Pinas, and you agree to waive any right to a jury trial.

13. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
